The seller agrees to warrant the following:
- The dog/puppy is purebred and register able with the
American Kennel Club (AKC). The registration papers will be provided to the
Buyer upon their return from AKC, following receipt of full purchase price of
the dog/puppy. All “pet quality” puppies are sold with AKC LIMITED
REGISTRATION papers, and it is understood by the buyer the requirements needed
to later obtain FULL REGISTRATION, should they so desire. (see attached
Clarksburg Kennel Limited Registration Policy)
- Seller warrants the health of the dog for 7 days after the
Buyer takes possession of the dog in order that the Buyer has the opportunity
to have the dog examined by a Doctor of Veterinary Medicine (DVM). If a
pre-existing malady is discovered during the examination, Seller will refund
or replace the dog/puppy (at Sellers option) under the provision that the
Buyer supplies the Seller with a written letter from the examining
veterinarian stating the nature of the malady, and that all paperwork and
documentation be returned to the Seller, along with the dog/puppy at the
Buyers expense.
Pre-existing maladies, for the purpose of this contract are defined as those
conditions existing in the dog at the time of the sale.
This definition does not include follow-up worming, or treatment for
intestinal upsets due to transportation and/or relocation of the dog.
Death occurring due to accident or neglect during this period is not the
seller’s responsibility.
- The dog/puppy will be current on vaccinations at the time
of sale, and seller will provide vaccination records to the buyer at time of
delivery. Puppies are tattooed in the right ear (occasionally both ears) at
the age of seven (7) weeks of age. Tattooing is our choice of permanent
identification for our kennel.
HIP WARRANTY: Our “pet quality” puppy's hips are warranted to pass OFA
preliminary evaluation or the German SV “a” stamp program at the age of 12
months old. This warranty expires at 12 months of age. We recommend
preliminary X-rays as early as 6 months old if you foresee any possibility of
problems developing. Notify us as soon as a problem is suspected with the
puppy's hips. Before a puppy is replaced, the Seller will request a copy of
all x-ray films taken of the puppy, and a copy of the OFA preliminary
evaluation. At our discretion, we may possibly recommend a “second opinion”
x-ray be taken (at the owner’s expense).
Note that feeding a quality brand of food, appropriate exercise and not
allowing your pup to become “overweight” has a tremendous impact on the proper
development of your puppy and his good health.
Note that a “pet quality puppy” (a puppy not sold for breeding purposes) that
may be evaluated with “mild” HD, can under most conditions, live a normal,
pain free life, therefore, replacement of a puppy with “mild HD” will be
determined on an individual basis with a mutual agreement between the breeder
and the owner of the pup.
NOTE: This is a replacement warranty
only, and the seller’s responsibility will be exclusively to REPLACE the puppy
with another puppy of equal value.
This warranty only applies to Hip Dysplasa, and does not apply to accidental
injuries.
This warranty will become NULL AND VOID if your pup is bred prior to x-ray’s.
- NO OTHER GUARANTEE HAS BEEN EXPRESSED OR IMPLIED.
- DEPOSITS: Deposits are accepted to hold a puppy from the above specified
litter, for purchase by the buyer until the puppy reaches the age of eight (8)
weeks. Deposits are non-refundable, with the exception that if the seller is
unable to deliver a healthy puppy of the gender desired, then the complete
deposit will either be refunded to the buyer or applied to another puppy from
another litter. This will be at the “buyer’s” choice.
- Puppy must be enrolled, attend and complete an eight week puppy obedience
class, or an agreed upon session of training/ socializing class.
- Any dispute or legal matters concerning this contract are to be settled in
NY State, in the County of Rensselaer.
