The seller agrees to warrant the following:
  1. The dog is purebred and register able with the American Kennel Club (AKC), and/or the United Schutzhund Clubs of America (USA), and/or the Verein fur Deutsche Schaeferhund (SV) of Germany. AKC and/or USA/SV registration papers will be provided to the Buyer upon their return from AKC and/or USA, following Seller’s receipt of full purchase price of the dog.
     
  2. Seller warrants the health of the dog for 7 days after the Buyer takes possession of the dog in order that the Buyer has the opportunity to have the dog examined by a Doctor of Veterinary Medicine (DVM). If a pre-existing malady is discovered during the examination, Seller will refund or replace the dog/puppy (at Seller’s option) under the provision that the Buyer supplies the Seller with a written letter from the examining veterinarian stating the nature of the malady, and that all paperwork and documentation be return to the Seller, along with the dog/puppy at the Buyer’s expense.
     Pre-existing maladies, for the purpose of this contract are defined as those conditions existing in the dog at the time of the sale.
    This definition does not include follow-up wormings, immunizations or side effects from immunizations, or treatment for intestinal upsets due to transportation and/or relocation of the dog.
    Death occurring due to accident or neglect during this period is not the sellers responsibility.
     
  3. The dog is warranted to have hips that will pass preliminary evaluation with the Orthopedic Foundation for Animals (OFA) or  the Verein fur Deutsche Schaferhund (SV) “a” stamp program at the age of 12 months as specified in the USA/OFA hip certification agreement. Seller may request a copy of all x-ray films taken of the dog. Prior to replacement of the dog, the Seller will request retaking of x-ray films that OFA deems questionable due to x-ray film quality or positioning of the dog. Second opinions and retakes requested by the Seller will be paid for by the Buyer.
     
  4. NO OTHER GUARANTEE HAS BEEN EXPRESSED OR IMPLIED.

  5. If any one of these warranties is breached, and the dog is returned to the Seller at the Buyer’s expense, Seller will replace the dog with another quality puppy. Availability and choice of the replacement dog will be determined by the Seller. All returned dogs must be in good condition, free of heartworms and brucellosis (as determined by the Seller’s choice of DVM) and must not have been bred at any time prior to replacement.

All warranties herein described will be considered NULL and VOID in the event that the Buyer:
  1. Fails to maintain the dog in a clean, healthy, safe environment at all times,
  2. Fails to follow a DVM’s schedule of immunization and parasite control, including heartworm testing and prevention,
  3. Refuses to feed the dog in the recommended manner.
  4. Fails to care for and/or train the dog in a humane manner.
  5. Breeds a male dog prior to 24 months of age, or a female dog prior to 20 months of age,
  6. Sells, gives away, or in any other manner transfers ownership of the dog in whole or in part to any other person or persons.
  7. All legal disputes concerning this contract is to be settled in The State of NY, in the County of Rensselaer.
